What does human judgment really look like when AI enters the leave and accommodation process? 

Human Oversight: A Core Expectation of Voluntary AI Frameworks 

While federal and state AI regulations continue to evolve, voluntary AI governance frameworks are emerging as a practical and consistent way for organizations to demonstrate responsible AI use. These frameworks help companies align their systems with societal expectations on responsible AI use even before laws require it. The NIST AI Risk Management Framework (AI RMF) and the US Financial Services AI Risk Management Framework (FS AI RMF) together provide complementary, sectoragnostic and sectorspecific guidance for responsible AI governance.  

Employers need to know NIST AI RMF because it is the leading voluntary, crossindustry playbook for managing AI risks.  For insurers, TPAs, and financial institutions, the FS AI RMF translates those same principles into sectorspecific controls that regulators, auditors, and enterprise customers increasingly expect to see. Together, both frameworks reinforce the core idea that AI can support decisionmaking, but meaningful human intervention must remain central. 

Human oversight is a core expectation in the NIST AI RMF, which requires organizations to define and document the roles and responsibilities of the people who monitor and guide AI systems.  The framework also emphasizes that humans must understand an AI system’s limitations, context, and potential risks, and be able to step in when the system shows uncertainty, conflict, or possible harm.   

Under the FS AI RMF, human oversight is required for insurers whenever an AI system’s use, risk profile, or decision context creates the potential for material consumer impact, safety issues, regulatory exposure, or irreversible outcomes. Insurers must clearly define who is responsible for oversight, train those individuals appropriately, and set firm thresholds for when human judgment must step in. Ongoing monitoring is also expected to ensure humans can effectively review, challenge, and override AI outputs. 

“Human in the Loop” and Defining Meaningful Human Oversight

You may have heard of the concept of HumanintheLoop (HITL) in conversations around AI and responsible use. Fun fact: the term isn’t new, nor is it exclusive to AI. It is a longstanding concept used in early computing, military, aviation, and other human-machine systems that required human supervision. In a nutshell, HITL has always meant that people should stay actively involved to review, guide, and correct outputs before decisions are made. 

The two voluntary frameworks embed HITL principles, although they don’t use that exact label. NIST recognizes that “human-AI configurations can span from fully autonomous to fully manual.” NIST states directly that some systems may not require human oversight, while others specifically require it, and that organizations must clearly define and differentiate the human roles in decision making and oversight. Those individuals must understand the system’s limits, and they must have the authority to pause or override outputs. In the FS AI RMF, meaningful human oversight for insurers means clearly defining, training, and empowering human reviewers to step in whenever an AIsupported decision could materially affect a policyholder.  

Simply having a person involved at some point in the workflow doesn’t automatically make the oversight meaningful. True oversight requires humans who are informed, empowered, and actively engaged. 

Meaningful Human Oversight in AI-Enabled Leave and Accommodation Management

As AI and automated systems increasingly power endtoend workplace workflows, including a growing number of processes in leave and accommodations management, meaningful human oversight becomes essential to ensuring decisions remain fair and accurate under all applicable leave and accommodation laws: 

  • Train and empower reviewers: equip personnel with the skills to understand leave and accommodation laws, recognize potential bias or errors, and have the authority to pause, question, or override AI suggestions. 
  • Review AIsupported recommendations with full context: have reviewers use AI tools judiciously, treat them as aids (not as the final decisionmaker), and do not rubberstamp automated outputs. 
  • Build in escalation triggers: if there are conflicting information, sensitive accommodation requests, complex medical situations, or potential denials, there should be triggers for mandatory human review.
